A400 establishes relationships with its suppliers, partners, and clients based on the organization’s values and principles, prioritizing loyalty and good faith in its relations, and establishing objective and clear communication to create and maintain a relationship of mutual trust.<\/p>

A400 peremptorily recognizes the obligation to respect the confidentiality of information exchanged with its suppliers, partners, and clients, committing not to disclose the exchanged information.A400 undertakes not to use, for its own benefit, data to which it has access and will never disclose it to third parties without the formal consent of the legitimate data subjects.<\/p>

A400 is committed, as the data controller, to the rules established in the Personal Data Protection Law and the General Data Protection Regulation, regarding the protection of personal data and the corresponding circulation of such data, whose principles it strictly observes.<\/p>

Consequently, it has established Internal Data Protection Regulations, in accordance with the rules established by Law No. 58\/2019, of August 8, as updated \u2013 the Personal Data Protection Law which ensures the execution, in the Portuguese legal order, of the GDPR \u2013 Regulation (EU) of the Parliament and of the Council of April 27, 2016, regarding the protection of personal data and the circulation of such data.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

\u2022 “Personal Data” means:<\/strong> information relating to an identified or identifiable natural person (Data Subject); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, online identifiers, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person;<\/p>

\u2022 “Data Subject”:<\/strong> within the scope of the activity carried out by A400, the concept includes, namely, managers, employees, former employees, workers, job applicants, interns, and suppliers. Visitors and all those individuals who maintain a relationship with the Company to whom the Personal Data relates; <\/p>

\u2022 “Processing”:<\/strong> an operation or a set of operations performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment orcombination, restriction, erasure, or destruction;<\/p>

\u2022 “Restriction of processing”:<\/strong> the marking of stored personal data with the aim of limiting their processing in the future;<\/p>

\u2022 “Consent”<\/strong> of the data subject: any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.<\/p>

\u2022 “Personal data breach”:<\/strong> a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored, or otherwise processed;<\/p>

\u2022 “Biometric data”:<\/strong> personal data resulting from specific technical processing relating to the physical, physiological, or behavioral characteristics of a natural person, which allow or confirm the unique identification of that natural person, such as facial images or dactyloscopic data;<\/p>

\u2022 “Data concerning health”:<\/strong> personal data related to the physical or mental health of a natural person, including the provision of health care services, which reveal information about his or her health status.<\/p>

\u2022 A400 Video Surveillance System for Image Recording:<\/strong> its purpose is the protection of persons and property, with due regard for constitutionally protected rights and interests, and it complies with the Law and the General Data Protection Regulation (EU) \u2013 registered with the PSP General Directorate.<\/p>

\u2022 A400 ensures that:<\/strong>– Only authorized and appropriate data are collected and processed, relevant to what is strictly necessary for the purposes for which they are collected and processed, according to the principle of data minimization;
– All data collected in the exercise of its activity are intended for specific, explicit, and legitimate purposes and will not be further processed in a manner incompatible with those purposes, in accordance with the principle of purpose limitation;
– Data are processed lawfully, fairly, and transparently, in accordance with the principle of lawfulness, fairness, and transparency;
– It adopts appropriate measures so that data qualified as inaccurate are erased or rectified, taking into account the purposes of the processing for which they were collected, in accordance with the principle of accuracy;
– It keeps data in a form that permits identification only for the period necessary for the purposes for which they were collected and processed, according to the principle of storage limitation;
– When personal data are necessary for the controller, or the processor, to prove compliance with contractual or other obligations, they are kept as long as the limitation period for the corresponding rights has not expired;
– When the purpose that motivated the initial or subsequent processing of personal data ceases, the controller proceeds with their destruction or anonymization;
– Data are processed in a way that ensures their security and confidentiality, including against unauthorized or unlawful processing and against accidental loss, destruction, or damage, according to the principle of integrity and confidentiality;
– Given the object and scope of its activity, A400 does not rent, sell, distribute, or commercially or otherwise make available data to any third party outside the scope of its data protection policy.<\/p>

\u2022 A400 collects authorized data according to its purpose, namely:<\/strong>– Personal data of workers, job applicants, interns, collaborators, clients, and suppliers, including:– Payment data for workers, interns, collaborators, clients, and suppliers, namely, IBAN, civil identification number, tax identification number, among others that prove absolutely necessary for their purpose;– Data of workers, namely, social security identification number, absences and delays, evaluation and performance results, disciplinary occurrences or facts that may indicate them, biometric data, among others absolutely necessary for their purpose.<\/p>

\u2022 Current and mandatory purposes of data processing:<\/strong>– Conclusion and execution of employment contracts;– Conclusion and execution of contracts with suppliers and clients;– Payroll processing;– Compliance with health and safety at work obligations;– Compliance with the obligation to conclude work accident insurance;– Conclusion and fulfillment of other insurance contracts, namely health insurance for workers;– Professional training and performance evaluation of workers;– Disciplinary processes of workers;– Attendance and punctuality control of workers;– Attachment of wages regularly notified by a bailiff or enforcement agent;– Compliance with legal standards or final court decisions.<\/p>

\u2022 Data sharing:<\/strong>Within the scope and exercise of its activity, A400 may share data with third parties, namely:– With service providers exclusively for specifically established purposes, these being contractually prohibited from processing the data, directly or indirectly, for any other purpose, for their own benefit or that of third parties, with the knowledge and acceptance of the data subject;– In compliance with legal and\/or contractual obligations;– With third-party Clients\/Contracting Entities within the scope of a service provision contract by A400, to the extent strictly necessary and with the knowledge and acceptance of the data subject.– At the request of the data subject and\/or with their consent, data may be shared with other entities identified by the subject.<\/p>

\u2022 Rights of the Data Subject:<\/strong>– The subject has the right of access, rectification, restriction, portability, erasure, and the right to object to data processing on justified grounds, under the following terms:
– The right to obtain clear, transparent, and easily understandable information about how A400 uses your data and what your rights are;
– A400 may refuse to provide the information requested by the data subject whenever, in doing so, it would have to reveal data of other people or if the requested information would harm the rights of another person;– The subject has the right to request A400 to take reasonable steps to correct their data that are incorrect or incomplete;– The subject has the right to obtain and reuse data for their own purposes;– The subject may request the erasure or deletion of their data provided there are no valid grounds for A400 to keep them or continue using them, or when their use is not lawful;– The subject has the right to object to a type of processing for reasons related to their particular situation, at any time during that processing, when justified.<\/p>

\u2022 Data Retention Period<\/strong>– A400 retains Data only for the time necessary to fulfill the specific purposes for which they are collected.– However, it may be legally compelled to retain some data for longer to comply with, namely: provisions in current laws on data retention for predefined periods; limitation periods under current laws; obligations to third parties; the final resolution of any disputes; guidelines issued by competent data protection authorities.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"
